Some states allow a spouse to inherit a community property share of the deceased owner’s IRA, regardless of the primary beneficiary. In a private letter ruling, the IRS denied a spouse’s claim to an IRA community property interest and rollover because state community property laws don’t apply to IRAs on a federal level.
